Welcome to MarryCrate. These Terms of Use govern your access to and use of the MarryCrate website, including our content, products, services, features, and other materials made available through the website.

By accessing or using this website, creating an account, or placing an order, you agree to these Terms of Use. If you do not agree with these terms, please do not use the website.

1. About MarryCrate

MarryCrate provides thoughtfully curated and personalized wedding gifts, including bridesmaid gifts, groomsmen gifts, wedding party gifts, culturally inspired collections, gift boxes, and related products. We also publish wedding guides, cultural resources, gifting ideas, planning information, and other educational and inspirational content.

Our goal is to help couples celebrate the people, traditions, and relationships that make their weddings meaningful.

2. Eligibility to Use Our Website

You may use this website only for lawful purposes.

By placing an order through MarryCrate, you represent that you are legally capable of entering into a binding agreement or are using the website with the involvement and permission of a parent or legal guardian where required. You agree not to use the website in a manner that violates applicable laws, interferes with the operation of the website, attempts to gain unauthorized access to our systems, or infringes upon the rights of MarryCrate or another person.

3. Products and Product Information

We make reasonable efforts to describe and photograph our products accurately.

However, because many MarryCrate products involve handcrafted details, textiles, jewelry, natural materials, personalization, printing, embroidery, packaging, or culturally inspired design elements, minor variations may occur.

Colors may also appear differently depending on your screen, device, lighting, photography, or display settings. Small variations that do not materially change the nature or intended use of a product are not considered defects. We reserve the right to modify, discontinue, replace, or update products and packaging when necessary.

4. Personalized and Custom Products

Many MarryCrate products may be personalized with information such as:

  • Names or initials
  • Wedding dates
  • Personal messages
  • Colors
  • Monograms
  • Custom wording
  • Other requested details

You are responsible for reviewing all personalization information carefully before submitting your order. Please verify spelling, capitalization, dates, names, and other custom details before checkout.

MarryCrate is not responsible for errors contained in personalization information submitted by the customer. If you discover an error after placing an order, contact us as soon as possible. We will make reasonable efforts to accommodate changes if production has not begun, but changes cannot be guaranteed once a customized product has entered production.

5. Customer-Submitted Content

When you provide names, photographs, messages, artwork, logos, designs, or other materials for customization, you represent that you have the necessary permission or rights to use those materials. You grant MarryCrate permission to use the submitted materials solely as reasonably necessary to create and fulfill your requested product or service.

You may not submit content that is unlawful, infringing, threatening, hateful, defamatory, obscene, or that violates another person’s intellectual property, privacy, or other legal rights. We reserve the right to decline customization requests that we reasonably believe violate these requirements.

6. Orders

Submitting an order does not necessarily mean that the order has been accepted.

We reserve the right to refuse or cancel an order when reasonably necessary, including in situations involving:

  • Product availability
  • Incorrect pricing or product information
  • Suspected fraud or unauthorized transactions
  • Technical or inventory errors
  • Customization requests we cannot reasonably fulfill
  • Shipping restrictions
  • Violations of these Terms

If we cancel an order after payment has been collected, the applicable amount will be refunded according to the original payment method, subject to our payment processor’s procedures.

7. Pricing and Payment

Prices displayed on the website are shown in U.S. dollars unless otherwise stated. Prices, promotions, product availability, and shipping charges may change without prior notice.

Applicable taxes, shipping charges, customization fees, and other charges will be displayed during checkout when applicable. We make reasonable efforts to ensure pricing is accurate. If an obvious pricing or technical error occurs, we reserve the right to correct the error and cancel or adjust an affected order where legally permitted.

8. Culturally Inspired Products and Content

MarryCrate celebrates weddings across many cultures, faiths, regions, and family traditions. Our collections and editorial content may draw inspiration from wedding customs, colors, textiles, craftsmanship, ceremonies, and traditions from around the world.

Cultural traditions are diverse and continually evolving. Customs may differ significantly between families, communities, regions, faiths, generations, and countries. MarryCrate therefore does not represent that a particular product, tradition, recommendation, color, ceremony, or interpretation applies universally to every person belonging to a particular culture or community.

Our culturally inspired collections are intended to celebrate traditions respectfully rather than define them. This approach is consistent with MarryCrate’s editorial standard that countries are not single cultures and that modern families may blend, simplify, or adapt traditions in different ways.

9. Wedding and Cultural Information

Articles, guides, FAQs, gift recommendations, ceremony explanations, planning resources, and other editorial materials available through MarryCrate are provided for general informational and inspirational purposes.

They are not intended to replace advice from religious leaders, cultural authorities, wedding professionals, legal professionals, or other qualified advisers when such guidance is appropriate. Wedding traditions can vary considerably between families and communities. We encourage couples to follow the customs and traditions that are meaningful to their own families.

10. Intellectual Property

Unless otherwise stated, the MarryCrate website and its original content—including text, product descriptions, graphics, logos, photographs, illustrations, designs, collection names, website layouts, guides, downloadable resources, and other original materials—are owned by or licensed to MarryCrate and are protected by applicable intellectual property laws.

You may use the website for personal, non-commercial purposes.

You may not reproduce, republish, distribute, sell, scrape, systematically extract, modify, create derivative commercial works from, or commercially exploit MarryCrate content without prior written permission, except where permitted by law.

11. Reviews and Other User Content

If MarryCrate allows customers to submit reviews, photographs, comments, testimonials, or similar content, you remain responsible for the content you submit. You agree not to submit false, misleading, unlawful, defamatory, infringing, or abusive content.

By voluntarily submitting content for public display, you grant MarryCrate a non-exclusive right to display and use that content in connection with operating and promoting MarryCrate, subject to applicable law and our Privacy Policy.

12. Third-Party Services and Links

Our website may contain links to third-party websites or use third-party services for functions such as payment processing, shipping, analytics, social media, or other website features. MarryCrate does not control independent third-party websites and is not responsible for their content, availability, privacy practices, or terms.

We work to keep MarryCrate accessible and operating properly, but we cannot guarantee uninterrupted or error-free access. We may temporarily suspend, modify, update, or discontinue portions of the website for maintenance, security, technical, operational, or business reasons.

14. Disclaimer of Warranties

To the extent permitted by applicable law, the website and its content are provided on an “as available” basis. We make reasonable efforts to provide accurate product and website information, but we do not guarantee that every description, image, price, availability status, delivery estimate, cultural reference, or other piece of website information will always be completely error-free or current. Nothing in this section excludes warranties or consumer rights that cannot legally be excluded.

15. Governing Law and Jurisdiction

These Terms of Use and any dispute arising out of or relating to your use of the MarryCrate website, your purchase of products from MarryCrate, or your relationship with MarryCrate shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict-of-law principles, except to the extent otherwise required by applicable federal or state law.

Subject to the arbitration provisions below, any legal proceeding that is not subject to arbitration shall be brought in a court of competent jurisdiction located in the State of Maryland, unless applicable law requires otherwise.

16. Informal Dispute Resolution

We want an opportunity to resolve concerns directly before either party begins a formal proceeding. Before initiating arbitration or other legal proceedings, you agree to contact MarryCrate and provide a written description of the dispute, the order number if applicable, your contact information, and the resolution you are requesting.

MarryCrate and the customer agree to make a good-faith effort to resolve the dispute informally before proceeding to arbitration. Nothing in this section prevents either party from seeking relief when applicable law does not permit such a requirement.

17. Binding Individual Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms, the MarryCrate website, an order, a product, or your relationship with MarryCrate that cannot be resolved through the informal dispute-resolution process shall be resolved through binding arbitration on an individual basis rather than in court.

The arbitration shall be conducted by a mutually recognized arbitration provider pursuant to the provider’s applicable consumer arbitration rules and the Federal Arbitration Act, to the extent applicable.

The arbitrator may award any individual remedy or relief that would otherwise be available under applicable law and that the parties cannot lawfully waive.

Nothing in this arbitration provision is intended to prevent either party from bringing an eligible individual claim in small claims court, or from exercising any right that applicable law provides cannot be waived or subjected to arbitration.

18. Class Action and Collective Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND MARRYCRATE AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS.

Neither you nor MarryCrate will seek to have a dispute heard as a class action, collective action, representative action, consolidated action, or private attorney general action where such a waiver is legally permitted.

The arbitrator shall have authority to resolve claims and award relief only on an individual basis and shall not consolidate the claims of multiple customers or preside over any form of representative or class proceeding, except where applicable law requires otherwise.

If any portion of this class or collective action waiver is determined to be unenforceable with respect to a particular claim or remedy, that determination shall not automatically invalidate the remainder of the arbitration agreement or these Terms.

19. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MarryCrate and its owners, officers, employees, affiliates, agents, and service providers shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to your use of the website, purchase or use of a product, delayed delivery, loss of use, loss of opportunity, or other circumstances beyond MarryCrate’s reasonable control.

To the fullest extent permitted by applicable law, MarryCrate’s aggregate liability arising from or relating to a particular product or order shall not exceed the amount actually paid to MarryCrate for the product or order giving rise to the claim.

The foregoing limitations do not apply to liability, damages, statutory remedies, warranties, or other rights that cannot legally be excluded, waived, or limited under applicable federal or state law.

This section does not limit MarryCrate’s obligation to provide a refund, replacement, repair, or other remedy where required by applicable law.

20. No Consequential Damages for Wedding or Event Disruptions

MarryCrate products are frequently purchased for weddings and other time-sensitive celebrations. While we make reasonable efforts to process and ship orders according to stated timelines, MarryCrate cannot guarantee that circumstances outside our reasonable control—including carrier delays, severe weather, transportation interruptions, incorrect delivery information, or other third-party delays—will not affect delivery.

To the fullest extent permitted by applicable law, MarryCrate shall not be responsible for consequential losses arising from a delayed, lost, damaged, incorrect, or unavailable product, including expenses associated with wedding venues, travel, photography, catering, clothing, event postponement, replacement vendors, or other wedding or event expenses.

Any remedies available to you remain subject to rights that cannot legally be waived or limited.

21. Exceptions to Arbitration

Notwithstanding the arbitration provisions above, either party may bring an eligible individual claim in small claims court. MarryCrate may also seek appropriate injunctive or equitable relief relating to misuse of its intellectual property, trademarks, copyrighted materials, website, confidential information, or unauthorized access to its systems where permitted by applicable law.

Nothing in these Terms prevents a consumer from filing a complaint with, communicating with, or seeking assistance from a federal, state, or local government agency.

22. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law or severed where appropriate, and the remaining provisions shall remain in full force and effect.

If any portion of the arbitration agreement or class-action waiver is found unenforceable, the effect of that determination shall be limited to the particular provision, claim, or remedy at issue to the extent permitted by law.

Our collection and use of personal information are governed by our Privacy Policy, which should be reviewed together with these Terms.

24. Changes to These Terms

We may update these Terms of Use periodically to reflect changes to our website, products, services, business practices, or legal requirements. When changes are made, the revised version will be posted on this page with an updated “Last Updated” date.

Your continued use of the website following an update constitutes acceptance of the revised Terms to the extent permitted by applicable law.
